Introduction
Gaia Family I Inc. and its affiliates (“Gaia”, “we”, “our”) are committed to protecting the privacy and security of the personal information we collect about end customers and users of our services (“you/your”). This Privacy Policy is incorporated into our Terms of Use. All capitalized terms used in this Privacy Policy but not defined herein have the meanings assigned to them in the Terms of Use. We refer to the Website and other services provided by Gaia together in this Privacy Policy as the "Services".
We collect personal information when you:
- Create an account on our website (www.gaiafamily.com) (the "Website");
- Speak to our advisors;
- Use our chatbot or chat feature;
- Check your insurance eligibility;
- Inquire about our products;
- Request marketing to be sent to you;
- Give us feedback or contact us;
- Provide us with a scan of your document if this is required for "know your customer", anti-money laundering purposes or credit and affordability assessments;
- Interact with our website;
- Request information about a clinic;
- Receive treatment at one of Gaia's partner clinics;
- Attend one of our events; and
- Complete our customer surveys.
This Privacy Policy provides you with information about your rights and obligations and explains how, why and when we collect and process your personal information.

Scope of this Privacy Policy
This Privacy Policy applies to personal information that Gaia collects directly from you and from the third parties described below. Some information is instead governed by other notices and laws, as follows:
- Health information from our partner clinics. This Privacy Policy does not apply to personal information that we process on behalf of fertility clinics and covered entities while providing services to them. Our use of this personal information is governed by our agreements with the applicable fertility clinics and covered entities.
- Financial information. If you request or receive a financial product from Gaia (such as our credit or financing product), the non-public personal information we collect in connection with that product, including the credit, affordability, and sanctions checks we run with credit reference agencies such as Experian, is governed by our Financial Privacy Policy, a copy of which will be sent to you in connection with your financial product, and by the Gramm-Leach-Bliley Act and the Fair Credit Reporting Act. Because that information is regulated under those federal laws, certain of the U.S. state privacy rights described below may not apply to it.
- Consumer health data. Our separate Consumer Health Data Privacy Notice (set out below) describes how we collect, use, and share consumer health data and the choices you have under state consumer health data laws.
- Cookies. Our Cookie Policy https://gaiafamily.com/en-us/legal/cookie-policy describes the cookies and similar technologies we use and how you can manage them.
Eligibility (21 and over)
The Services are intended only for individuals who are 21 years of age or older. The Services are not directed to, and we do not knowingly collect personal information from, anyone under 21. If we learn that we have collected personal information from a person under 21, we will delete it. If you believe a person under 21 has provided us with personal information, please contact us at dataprotection@gaia.family.

Who we are and contact details
Gaia Family I Inc. is the operating company that provides the Services and is the primary business responsible for the personal information described in this Privacy Policy. Its affiliates include Gaia Fertility Limited and Gaia Family Inc. References to “Gaia”, “we”, “us” and “our” mean Gaia Family I Inc. and, where relevant, these affiliates.

Personal information we collect
The personal information we collect about you depends on the purpose for which you engage with us. We may collect and use the following data about you:
- Identity - full name, marital status, title, date of birth, and partner details if applicable.
- Contact - address, email address, telephone number(s), Gaia profile data.
- Account data - the username and password that you may set to establish an online account, date of birth, and biographical details.
- Relationship data - familial or other relationship to third parties whose personal information you may provide to us.
- Financial - bank account and payment card details.
- Transaction - details about payments to and from you.
- Usage - details about how you use our website.
- Marketing and communications - your preferences in receiving marketing from us and your communication preferences.
- Technical - internet protocol (IP) address, Gaia log in details, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access this website.
- Online activity data - pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Service, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our emails or clicked links within them.
- Medical - Health and Lifestyle data, see “Sensitive Personal Information” below.
Sensitive Personal Information
Some of the personal information we collect is sensitive by nature. "Sensitive personal information" includes certain government identifiers such as social security numbers; financial account credentials; precise geolocation; genetic and biometric data; health, sex life, or sexual orientation information; and racial or ethnic origin, religious beliefs, or union membership. The categories of Sensitive Personal Information that we hold, and process include:
- Health and lifestyle data - including details of pre-existing or past medical conditions, your family medical history, details regarding appointments and consultations with medical professionals, diagnoses, medical records, whether you do or have ever smoked, details regarding alcohol consumption.
- Financial data - including bank and/or card details that you provide to us to pay for Gaia’s Services or to repay your loan.
We collect sensitive personal information only to provide you Services that you have requested from us, and to perform or secure associated services on behalf of our business, such as customer service, processing payments, verifying customer information, maintaining and servicing customer accounts, or similar services. We will only collect and process this data with your consent, except where otherwise permitted by applicable law.
Business purposes for which we use personal information
When providing services to you, we may use your personal information for the following business purposes:
Where personal information is processed because it is necessary for the services you requested, we will be unable to provide our Services without the required information.
Sharing your data and third parties
Third parties assist us in our marketing efforts, to deliver our products to you and in the provision of our services. The type of information shared will depend on the third party: it can be identity, contact, financial, transaction, usage, marketing & communications, technical and health & lifestyle, but will be limited to what is necessary for the third party to provide services to us for purposes described in this privacy policy or allowed by applicable law. You have the right to opt out of data sharing with third parties for marketing purposes - see “Your rights and options” and “Your Privacy Choices: Sale and Sharing of Personal Information” below for more information.
We only allow third parties to handle your personal information if we are satisfied they take appropriate measures to protect your personal information. We also impose contractual obligations on our service providers, to ensure they can only use your personal information to provide services to us and to you.
We may share your personal information with third parties that help us provide the messaging service, including, but not limited to, platform providers, phone companies, and other vendors who assist us in the delivery of text messages. We will not share your opt-in to an SMS short code campaign with a third party for purposes unrelated to supporting you in connection with that campaign and we will never share text messaging originator opt-in data and consent with any third parties.
We may disclose your personal information to law enforcement agencies and regulatory bodies to comply with our legal and regulatory obligations.
We may also need to share some personal information with other parties, such as potential buyers of some or all of our business or during a restructuring. Usually, data will be anonymized but this may not always be possible. The recipient of the data will be bound by confidentiality obligations.
The third parties we currently rely on or with whom we share personal information
We disclose personal information to the categories of third parties listed below, only as needed for the purposes described in this Privacy Policy or as permitted by applicable law. We do not disclose more personal information than is necessary for each purpose. The specific service providers and sub-processors we currently use are maintained by Gaia in its internal vendor register; a current list is available on request by emailing dataprotection@gaia.family.
- Cloud hosting and IT infrastructure providers;
- Data storage, data analytics, and data-pipeline providers;
- Payment processors, banks, and money-services providers;
- Credit reference agencies, identity-verification, and anti-fraud providers (including for credit, affordability, and sanctions checks);
- Communications providers (email, SMS, telephone, and chat);
- Customer-relationship-management and marketing providers;
- Advertising and web-analytics partners (subject to your choices described in “Your Privacy Choices” below);
- Insurance-eligibility-check providers;
- Partner fertility clinics (medical information is shared only with your consent, as described in this Privacy Policy and our Consumer Health Data Privacy Notice);
- Document-management and e-signature providers;
- Survey and feedback providers;
- Professional advisers (legal, accounting, and audit); and
- Law enforcement, regulators, courts, and other parties where required by law, to protect our rights, or in connection with a corporate transaction such as a merger, financing, or sale of assets.
We do not share text messaging originator opt-in data or consent with any third party for any purpose.
Cookies and Analytical Tools
We and our third-party service providers collect personal information through cookies, server logs, pixel tags, and similar technologies. Our Cookie Policy describes all cookies and similar technologies we use and explains how you can manage them. The information below explains how we use these technologies for advertising and analytics purposes specifically, and the choices you have.
Browser and device controls. Most web browsers are set to accept cookies by default. You can disable or refuse cookies at any time through your browser preferences. On mobile devices, you can manage data sharing through your device's privacy and security settings. Please note that some parts of our Services may not function properly or may be slower if you refuse certain cookies.
Global Privacy Control. We honor the Global Privacy Control opt-out signal. For information about GPC, please visit: https://globalprivacycontrol.org/.
Do not track. Because there is not yet a consensus on how companies should respond to web browser-based do-not-track (“DNT”) mechanisms, we do not respond to web browser-based DNT signals at this time. Please note that not all tracking will stop even if you delete cookies. For information about Do Not Track, please visit: www.allaboutdnt.org.
Advertising technologies and third-party analytics
We use third-party analytics and advertising tools on our website and digital properties, including tools provided by Meta Platforms, Inc. ("Meta"), and Google LLC. These tools may collect certain information about your interactions with our website, including pages visited, features used, and actions taken.
Categories of information that may be shared with these third parties include: unique identifiers and device information, IP addresses, pages visited and actions taken on our website, and, where you have provided it to us and you have given your consent as described below, information relating to your interest in fertility treatments or reproductive health services.
We do not knowingly share the content of health questionnaires, medical histories, or specific treatment details with advertising platforms. We have implemented technical controls designed to limit the data transmitted to advertising platforms from pages on which you provide health information.
We will only activate advertising and analytics tools that may process health-indicative information after you have given your consent via our cookie banner. You may withdraw your consent at any time by emailing us at dataprotection@gaia.family. Withdrawing consent will not affect the lawfulness of processing based on consent before its withdrawal.
For California residents: We do not sell your sensitive personal information, including health-related data, as defined under the California Consumer Privacy Act.
Interest based advertising opt-outs
You may opt out of interest-based advertising from participating companies through the following industry tools: Network Advertising Initiative (optout.networkadvertising.org), Digital Advertising Alliance (optout.aboutads.info), Google Ads Settings (adssettings.google.com), and Meta Ad Preferences (facebook.com/ads/preferences). These opt-outs are device- and browser-specific and do not prevent you from seeing ads; they prevent participating companies from delivering ads targeted based on your inferred interests.
Chat services
Gaia provides a chatbot and chat features powered by artificial intelligence (collectively, our “chatbot”). When you submit a question or prompt in our chatbot, you consent to the recording, collection, processing, disclosure, retention, and use of your question(s)/prompt(s) and the chatbot’s response(s) (the “Conversation”). We and our service providers may collect, process, retain and use the Conversation for the following purposes: communication with you, fraud prevention, research, development, analytical and archival purposes, to improve, maintain and provide the chatbot or other services, and to assist you further if you contact us. We may associate your Conversation to other information about you, including but not limited to your IP address, location, name, or social media profile and to your account/profile. You understand and agree that we may share the Conversation with our service providers or other third parties. The service providers or third parties may use the Conversation to assist us with associating information about you to the Conversation or to help us with customer support or technical questions. You agree that if you include your contact information, such as your telephone number or email address, your contact information may be used to associate information about you to the Conversation and that we may contact you using the contact information you provided.
Text messaging
With your consent, we may send you text messages (SMS/MMS) for purposes including appointment reminders, account updates, member support, and — if you have separately opted in — marketing communications about Gaia products and services.
Opt-out: To stop receiving marketing text messages, reply STOP to any marketing text from us. For transactional and account texts, contact us at dataprotection@gaia.family to opt out.
Message frequency: Message frequency varies. Message and data rates may apply.
We will not share your SMS opt-in status or phone number with any third party for their own marketing purposes.
How long we keep your personal information
We keep your personal information only for as long as we need it. The length of time depends on why we collected it and the following factors:
- The purpose it was collected for. We retain your information for as long as needed to deliver the relevant service or fulfill the purpose we described when we collected it. Once that purpose is met, we delete or restrict it.
- Legal and regulatory obligations. Some laws require us to keep certain records for a minimum period, including records relating to credit applications and healthcare privacy compliance. Where a legal minimum applies, we keep the relevant records for at least that long.
- Dispute resolution. We may retain information for as long as a legal claim could reasonably arise in connection with it.
- Your rights requests. We are required by law to keep a record of any access, deletion, or correction request you make, and how we responded, for a minimum period. We use those records only to demonstrate our compliance.
At the end of the retention period, your personal information will be securely deleted or anonymized, for example by aggregation with other data, so that it can be used in a non-identifiable way for statistical analysis and business planning. The retention period of your personal information may need to be extended where we require this to bring or defend legal claims.
Data analysis and research
Gaia will anonymize your information for health-related studies, or research or evaluation in which Gaia will participate. The types of data which may be used for analysis and research purposes include details about a patient (e.g. age, cause of infertility, lifestyle), lab results (e.g. blood test results, hormone levels), information about cycle planning, the cycle itself, the stimulation phase and egg collection (e.g. stimulation treatment, number of follicles, number of collected eggs), information about embryology and the embryo transfer, results of ultrasound scans, and details about the success or otherwise of a pregnancy.
Once information is truly anonymized, it does not relate to a person and it is impossible to identify a person from that data. As a result this type of information is no longer considered “personal information.”
The purposes for which Gaia will use this analysis and research information are:
- To report on Gaia’s performance based on statistical studies (e.g., pregnancy rate, birth rate, etc.). Any reporting information will be aggregated, and it will never be possible to identify you from this.
- To improve Gaia’s services to you.
How we protect your data
We maintain technical, organizational, and physical safeguards designed to protect your personal information against unauthorized access, loss, misuse, and disclosure. Access to your personal information is restricted to those with a genuine business need, and all staff handling personal information are subject to confidentiality obligations. In the event of a data breach affecting your personal information, we will notify you and the relevant authorities as required by applicable law.
Your rights and options
Depending on where you live, you may have some or all of the following rights in relation to your personal information, subject to verification and applicable exceptions:
- Access and confirmation: request confirmation of whether we process your personal information and obtain a copy of it, including the specific pieces of information we hold about you.
- Correction: request that we correct any inaccurate personal information we hold about you.
- Deletion: request that we delete your personal information.
- Portability: request a portable copy of your personal information in a format that allows you to transfer it to another provider.
- Opt-out of sale or sharing: opt out of the sale or sharing of your personal information and of targeted advertising.
- Opt-out of profiling: opt out of certain profiling or automated decision-making.
- Limit sensitive personal information: direct us to limit the use and disclosure of your sensitive personal information to those uses necessary to provide the services you have requested and other purposes permitted by law.
We will not charge you a fee to exercise any of these rights, though we may charge a reasonable fee or decline a request that is clearly unfounded or excessive. We will not discriminate against you for exercising any of your privacy rights. We will not deny you services, charge you a different price, or provide you a different level or quality of services because you exercised your rights, except for any difference reasonably related to a lawful financial incentive you have chosen to join.
To exercise any of these rights, email us at dataprotection@gaia.family. We may need to verify your identity before processing your request. We will respond within 45 days, which we may extend by a further 45 days where permitted by applicable law, in which case we will notify you within the first 45-day period.
Residents of Nevada may submit a request to opt out of the sale of certain personal information by emailing dataprotection@gaia.family.
You may use an authorized agent to submit a request on your behalf. We may require the agent to provide proof that you gave them signed permission to submit the request, and may require you to confirm directly with us that you authorized the agent, as permitted by law.
Appeals. If we decline to take action on your request, you may appeal that decision by emailing dataprotection@gaia.family with the subject line "Privacy Appeal." We will respond within the period required by applicable law and explain the reasons for our decision. If your appeal is denied, you may submit a complaint to your state Attorney General.
Your Privacy Choices: Sale and Sharing of Personal Information
We do not sell your personal information for money. However, like many online businesses, we use advertising and analytics cookies and similar technologies (for example, from Meta and Google) that may disclose certain online identifiers and activity to those partners for cross-context behavioral advertising. Under several U.S. state privacy laws, this type of disclosure may be treated as a “sale” or “sharing” of personal information.
You can opt out of this sharing at any time by: (1) emailing us at dataprotection@gaia.family; and (2) enabling a recognized opt-out preference signal such as the Global Privacy Control, which we honor. In addition, if you reject additional (non-essential) cookies through our cookie banner, the related cookie-based advertising and analytics sharing will stop; see our Cookie Policy for more on that choice. We do not knowingly sell or share the personal information of consumers under 16 years of age.
Financial Incentives
We may offer financial incentives, such as referral schemes, discounts, or credits, in exchange for the collection or processing of certain personal information. Participation is always optional and requires your prior opt-in consent, which you may withdraw at any time. The material terms of each program are provided when you enroll, and any difference in price or benefit is reasonably related to the value of your data to Gaia. No Geofencing of Health Care Facilities
We do not establish a geofence around any entity that provides in-person health care services in order to identify or track consumers, collect consumer health data, or send advertisements or messages relating to consumer health data or health care services.
Consumer Health Data
If you are a resident of a state with a consumer health data law (such as Washington, Nevada, or Connecticut), please see our separate Consumer Health Data Privacy Notice below, which describes the consumer health data we collect, how we use and share it, the categories of third parties and the specific affiliates that may receive it, and how you can withdraw consent or request deletion.
International Data Transfers
Gaia is a US-based company that operates primarily in the United States. However, some of our affiliates and service providers are located in other countries, including the United Kingdom. When we transfer personal information outside the United States, we take steps to ensure that the information receives an appropriate level of protection, including through contractual safeguards with our affiliates and service providers.

Changes to this privacy policy
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. Updated versions of this policy will be posted on our website.
Your continued use of our Services after the effective date of a revised notice constitutes your acceptance of the update. If you do not agree to the revised notice, please stop using the Services and contact us to close your account.
Gaia Consumer Health Data Privacy Notice
Effective Date: June 24, 2026
This Consumer Health Data Privacy Notice (the “Notice”) explains how Gaia Family I Inc. and its affiliates (“Gaia”, “we”, “us”, “our”) collect, use, and share “consumer health data” as defined under U.S. state consumer health data laws, including the Washington My Health My Data Act, Nevada Senate Bill 370, and the Connecticut Data Privacy Act. It supplements, and should be read together with, the Gaia Privacy Policy.
This Notice does not apply to: (a) protected health information that we receive from our partner fertility clinics, which we handle as a business associate under the Health Insurance Portability and Accountability Act and our agreements with those clinics; or (b) information regulated by the Gramm-Leach-Bliley Act or the Fair Credit Reporting Act.

Gaia Family I Inc. is the operating company that provides the Services. Its affiliates are Gaia Fertility Limited and Gaia Family Inc.
Categories of consumer health data we collect
- Fertility, reproductive, and pregnancy information (for example, fertility conditions, IVF and IUI treatment details, cycle information, and pregnancy outcomes).
- Health conditions, diagnoses, and medical history, including family medical history.
- Information about appointments, consultations, and treatment with medical professionals.
- Measurements and lifestyle information bearing on health (for example, height, weight and BMI).
- Medications and treatments.
- Information that identifies you as seeking health care services.
- Any other information you provide that identifies your past, present, or future physical or mental health status.
Categories of sources
- You, directly (for example, through forms, questionnaires, our chatbot, calls, and surveys).
- Our partner fertility clinics, with your consent.
- Service providers acting on our behalf.
Purposes for which we collect and use consumer health data
- To provide and administer the Services and your Gaia Plan.
- To check insurance eligibility where you request it.
- To communicate with you about your care and our Services and to provide customer support.
- For safety, security, and fraud prevention.
- To comply with our legal obligations.
- With your separate consent, for research and to improve our Services, on a de-identified basis where possible.
We will not collect, use, or share consumer health data for any purpose not described in this Notice without first obtaining your affirmative, opt-in consent.
Categories of consumer health data we share
Where we share consumer health data, the categories shared are the same as the categories we collect (listed above), limited to what is necessary for the relevant purpose.
Categories of third parties and affiliates that may receive consumer health data
Affiliates. Gaia Family I Inc., Gaia Fertility Limited, and Gaia Family Inc.
Categories of third parties:
- Partner fertility clinics (with your consent).
- Cloud hosting and IT infrastructure providers.
- Data storage and data analytics providers.
- Communications providers (email, SMS, telephone, and chat).
- Customer-support providers.
- Professional advisers (legal, accounting, and audit).
- Law enforcement, regulators, and courts, where required by law.
We do not sell consumer health data, and we do not share consumer health data for advertising. Any sale of consumer health data, or any sharing beyond what is necessary to provide a product or service you have requested, would occur only with your separate, valid authorization.
Consent and how to withdraw it
We collect consumer health data only (a) with your consent for a specified purpose, or (b) to the extent necessary to provide a product or service that you have requested. We obtain consent to share consumer health data that is separate and distinct from the consent to collect it. You may withdraw your consent at any time by emailing dataprotection@gaia.family. Withdrawing consent does not affect processing that took place before your withdrawal.
Your rights
- Confirm whether we collect, share, or sell your consumer health data, and access that data.
- Obtain a list of all third parties and affiliates with whom we have shared or to whom we have sold (if applicable) your consumer health data.
- Withdraw your consent to the collection and sharing of your consumer health data.
- Request deletion of your consumer health data, including from our archived and backup systems; we will also notify our service providers of your deletion request.
To exercise these rights, email dataprotection@gaia.family. We will verify your request using a secure and reliable method and will respond within 45 days. We will not require you to create a new account to exercise your rights, and we will not discriminate against you for exercising them.
Appeals
If we decline to take action on your request, you may appeal by emailing dataprotection@gaia.family with the subject line “Health Data Appeal.” We will respond within the time required by applicable law and explain our decision. If your appeal is denied, you may submit a complaint to your state Attorney General.
Collection over time and across sites
We do not permit third parties to collect your consumer health data over time and across different websites or online services through our Services for their own purposes.
Changes to this Notice
We may update this Notice from time to time. If we make a material change, we will post the updated Notice with a new effective date and, where required by law, provide notice by other appropriate means before the change takes effect.
